Terms of service

Please read these Terms of Service carefully before using Sift. By creating an account or using any part of the service, you agree to be bound by these terms. If you do not agree to these terms, you must not use the service.

1. Definitions

In these Terms of Service, the following words have the meanings set out below:

  • "Sift", "we", "us" or "our" means Growth Alliance LLC, the company that operates the Sift service.
  • "Service" means the Sift web application at siftrecruit.com, the Sift browser extension for Google Chrome and Microsoft Edge, and any related services, APIs or tools we provide.
  • "User", "you" or "your" means any individual or business entity that creates a Sift account and uses the Service.
  • "Organisation" means a business, company or other entity that is registered within Sift, under which one or more Users may operate.
  • "Organisation Owner" means the User who creates an Organisation within Sift, or who is designated as the owner or administrator of that Organisation. The Organisation Owner accepts these terms on behalf of the Organisation and all Users within it.
  • "Candidate" means any individual whose information is added to or processed through the Service by a User.
  • "Candidate Screened" means a Candidate to whom the Sift AI has sent a message and from whom a response has been received. A Candidate is not considered screened if no response is received.
  • "User Content" means any data, text, messages, job descriptions, screening criteria, templates, images or other materials that a User uploads, creates or submits through the Service.
  • "Subscription" means your paid access to the Service under a subscription plan.
  • "Billing Cycle" means the recurring period (typically monthly) over which your Subscription is billed.
  • "SMS Segment" means a single unit of an SMS message as billed by mobile carriers. A message may use one or more Segments depending on its length and the characters it contains, as described in Section 3.2.
  • "Beta Feature" means any feature, tool or functionality that is designated as beta, preview, early access or experimental.

2. Account registration

To use Sift, you must create an account and provide accurate, complete and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

If you create an Organisation, you represent and warrant that you have the authority to bind that Organisation to these terms. The Organisation Owner is responsible for managing Users within the Organisation, including granting and revoking access.

Each Organisation is treated as a separate account for billing purposes. If you operate multiple Organisations, each will be billed independently.

You must be at least 18 years of age to create an account. By creating an account, you confirm that you meet this requirement.

We reserve the right to suspend or terminate any account that we reasonably believe is in breach of these terms, is being used fraudulently, or poses a risk to the security or integrity of the Service.

3. The Service

Sift is an AI-powered recruitment screening service. The Service allows you to manage candidate outreach, screening and interview scheduling. It includes a web application and a browser extension.

The browser extension operates on supported job board and recruitment websites. It allows you to add candidate information to Sift from those websites when you actively engage with the extension. The extension requires you to be signed in to your Sift account.

3.1 AI-assisted features

The Service includes features powered by artificial intelligence, including automated candidate outreach, screening conversations and follow-up messaging. You acknowledge and agree that:

  • AI-generated content (including messages sent to Candidates on your behalf) may contain errors, inaccuracies or inappropriate responses. We do not guarantee the accuracy, completeness or suitability of any AI-generated content.
  • You are solely responsible for reviewing, approving and overseeing all recruitment activity conducted through the Service, including any communications sent to Candidates by the Sift AI.
  • The Service is designed to assist your recruitment decisions, not to make them on your behalf. You retain full responsibility for all hiring and selection decisions.
  • The Sift AI may not always accurately represent your business, your requirements or your intended tone. You should review AI-generated communications before they are sent where the Service provides the option to do so, and monitor ongoing conversations.
  • We are not liable for any loss, damage or claim arising from the content of AI-generated messages, including any inaccurate, misleading or inappropriate statements made by the AI to Candidates.
  • We are not liable for any recruitment decisions you make based on AI-assisted screening, or for any claims brought against you by Candidates in connection with your use of the Service.

3.2 Messaging channels

The Service communicates with Candidates through messaging channels on your behalf. The available channels and associated costs are as follows:

  • WhatsApp: If you connect a WhatsApp account (personal or WhatsApp Business) to Sift, messages sent to Candidates through your connected account are included in your Subscription at no additional charge.
  • SMS: Where a WhatsApp account is not connected, or where WhatsApp delivery is not available, messaging will default to SMS. SMS is billed per SMS Segment, not per message. A short, standard message typically counts as one Segment. Longer messages, and messages containing emojis, accented letters or non-Latin scripts, will be split into multiple Segments and billed accordingly. Current per-segment rates are set out on the billing page within the Service.

It is your responsibility to review the applicable per-segment rates before enabling SMS-based features, and to be aware that the length and content of your message templates can affect the number of Segments billed. You are responsible for ensuring that you have the right to contact Candidates through the messaging channels you use.

3.3 Beta features

We may from time to time make Beta Features available to you. Beta Features are provided for testing and evaluation purposes and may not be complete, fully functional or reliable.

You acknowledge and agree that:

  • Beta Features are provided "as is" without warranty of any kind.
  • Beta Features may contain bugs, errors or other defects and may not perform as expected.
  • We may modify, suspend or discontinue any Beta Feature at any time without notice.
  • Beta Features are not covered by any service availability commitments.
  • We are not liable for any loss or damage arising from your use of or reliance on a Beta Feature.

We may invite you to provide feedback on Beta Features. Any feedback you provide is governed by Section 9 of these terms.

3.4 No guarantees

The Service is provided on an "as is" and "as available" basis. We do not guarantee that:

  • The Service will be uninterrupted, error-free, secure or free from bugs or viruses.
  • The Service will meet your specific requirements or expectations.
  • Any particular results will be achieved through your use of the Service.
  • Candidates will respond to outreach or screening messages.
  • The AI will perform consistently or produce the same output for the same input.

We do not make any commitment regarding uptime or service availability. While we aim to provide a reliable service, we may need to carry out maintenance, updates or other work that temporarily affects availability. We will endeavour to give reasonable notice of planned downtime where possible.

4. Subscription and billing

4.1 Subscription fees

Access to the Service requires a paid Subscription. Your Subscription includes a base fee which is billed at the beginning of each Billing Cycle (typically monthly, unless otherwise agreed).

4.2 Per-candidate charges

In addition to the base Subscription fee, you will be charged a per-candidate fee of £0.50 (fifty pence) per Candidate Screened. This charge applies only when a Candidate Screened event occurs (that is, when the Sift AI sends a message to a Candidate and a response is received from that Candidate). If no response is received, no per-candidate charge is incurred.

Per-candidate charges are calculated at the end of each Billing Cycle and billed in arrears for the Candidates Screened during the preceding Billing Cycle.

4.3 Messaging charges

Messages sent to Candidates through a connected WhatsApp account (personal or WhatsApp Business) are included in your Subscription at no additional charge.

Where messages are sent via SMS, charges apply per SMS Segment sent. The number of Segments a message uses depends on its length and the characters it contains, as described in Section 3.2. Current per-segment rates are set out on the billing page within the Service.

SMS charges are calculated at the end of each Billing Cycle and billed in arrears alongside per-candidate charges.

We reserve the right to update messaging rates from time to time. Changes to rates will be communicated through the Service and will apply from the next Billing Cycle following the date of notification.

4.4 Payment

All payments are processed via Stripe. By subscribing to the Service, you authorise us to charge your chosen payment method for the applicable fees. You are responsible for keeping your payment information up to date.

All fees are stated in pounds sterling (GBP) unless otherwise specified. Applicable taxes may be added depending on your location.

If a payment fails, we will notify you and attempt to collect the outstanding amount. If payment remains outstanding, we reserve the right to suspend your access to the Service until payment is made.

4.5 No refunds

All fees are non-refundable except as expressly set out in these terms or as required by applicable law. Base subscription fees are not refunded on a pro-rata basis if you cancel mid-cycle. Per-candidate and messaging charges are not refundable once incurred.

If we terminate your account other than for your breach of these terms, we will provide a pro-rata refund of any prepaid base subscription fee for the unused portion of your current Billing Cycle.

5. Cancellation

You may cancel your Subscription at any time through the account settings within the Service. Cancellation takes effect at the end of your current Billing Cycle. You will continue to have access to the Service until the end of that Billing Cycle.

On cancellation, any outstanding per-candidate or messaging charges incurred during the current or preceding Billing Cycle will be calculated and billed as part of your final invoice.

After your Subscription ends, your account data will be retained for 30 days, during which time you may request an export of your data. After 30 days, your account and all associated data will be permanently deleted in accordance with our Privacy Policy.

6. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these terms. In particular, you agree not to use the Service:

  • In any way that violates applicable local, national or international laws or regulations.
  • To discriminate against Candidates on the basis of any protected characteristic, including but not limited to age, race, sex, disability, religion, sexual orientation or pregnancy.
  • To send unsolicited bulk communications or spam to Candidates.
  • To collect or process Candidate data without a lawful basis for doing so.
  • To impersonate any person or entity, or to misrepresent your identity or your business.
  • To introduce viruses, malware or other harmful code into the Service.
  • To attempt to gain unauthorised access to any part of the Service or its infrastructure.
  • To reverse engineer, decompile or disassemble any part of the Service.
  • To use automated tools or scripts to access or interact with the Service in a way that places excessive load on our infrastructure.
  • In a way that could bring Sift or Growth Alliance LLC into disrepute.

We reserve the right to suspend or terminate your account immediately if we reasonably believe you are in breach of this section.

7. Data and privacy

Our Privacy Policy at siftrecruit.com/privacy explains how we collect, use and protect personal data in connection with the Service. By using the Service, you agree to our Privacy Policy.

You agree to comply with all applicable data protection laws in your use of the Service, including but not limited to the UK General Data Protection Regulation (UK GDPR), the EU General Data Protection Regulation (EU GDPR) and the Data Protection Act 2018.

You agree to:

  • Only add Candidate data to the Service where you have a lawful basis to do so.
  • Provide Candidates with appropriate notices regarding how their data will be used, including use of AI-assisted screening tools.
  • Respond to any Candidate data subject requests in accordance with applicable law.
  • Maintain appropriate security measures for any data you export from the Service.
  • Not use the Service to develop a competing product or service.
  • Not share your account credentials with any unauthorised person.

You acknowledge that you are a data controller in respect of the Candidate personal data you process through Sift, and that we act as a data processor on your behalf. The allocation of responsibilities between us is as described in our Privacy Policy.

8. User Content

You retain ownership of all User Content that you upload, create or submit through the Service.

By using the Service, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, copy, process and display your User Content solely for the purpose of providing and operating the Service. This licence ends when you delete your User Content or close your account (subject to our data retention periods as set out in our Privacy Policy).

We do not use your User Content to train or improve our AI models. Your data is used only to provide the Service to you.

You are responsible for ensuring that your User Content does not infringe the rights of any third party, and does not contain any unlawful, defamatory or otherwise objectionable material.

9. Feedback

If you provide us with any feedback, suggestions, ideas, feature requests or other input regarding the Service (collectively, "Feedback"), you agree that we may use, reproduce, modify, distribute and commercialise that Feedback without restriction, obligation or compensation to you.

By submitting Feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use the Feedback for any purpose, including to develop and improve the Service. You waive any moral rights in the Feedback to the extent permitted by law.

Nothing in this section obliges you to provide Feedback.

10. Intellectual property

The Service, including its design, features, functionality, code, documentation and all related intellectual property, is and remains the property of Growth Alliance LLC. Nothing in these terms grants you any right, title or interest in the Service other than the limited right to use it in accordance with these terms.

You may not copy, modify, distribute, sell, lease or create derivative works based on any part of the Service without our prior written consent.

"Sift" and associated branding are trademarks of Growth Alliance LLC. You may not use our trademarks without our prior written permission.

11. Third-party services

The Service may integrate with or allow connections to third-party services (such as Google Calendar, WhatsApp, job boards and messaging platforms). Your use of any third-party service is subject to that service's own terms and conditions and privacy policy.

We are not responsible for the availability, accuracy or content of any third-party service, and we are not liable for any loss or damage arising from your use of such services in connection with Sift.

If a third-party service modifies its terms, restricts access or becomes unavailable, this may affect the functionality of the Service. We are not liable for any such impact and are under no obligation to replace or replicate the functionality of any third-party service.

12. Limitation of liability

12.1 Exclusion of certain losses

To the maximum extent permitted by law, we shall not be liable to you for any:

  • Indirect, incidental, special, consequential or punitive damages.
  • Loss of profits, revenue, business, anticipated savings or goodwill.
  • Loss of data or data corruption (except to the extent caused by our negligence).
  • Losses arising from your reliance on AI-generated content or screening outcomes.
  • Losses arising from any recruitment decision you make using the Service.
  • Losses arising from any claim brought against you by a Candidate.
  • Losses arising from the unavailability of the Service or any interruption to the Service.
  • Losses arising from your use of or reliance on any Beta Feature.

12.2 Cap on liability

Subject to Section 12.3, our total aggregate liability to you in respect of all claims arising out of or in connection with these terms or your use of the Service shall not exceed the total fees paid by you to us in the 12 months immediately preceding the event giving rise to the claim.

12.3 Nothing excluded

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully excluded or limited under the laws of England and Wales.

13. Indemnification

You agree to indemnify and hold harmless Growth Alliance LLC, its officers, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service.
  • Your breach of these terms.
  • Your violation of any applicable law or regulation.
  • Any Candidate data you process through the Service.
  • Any claim by a Candidate relating to your recruitment practices or your use of the Service.
  • Any User Content you submit through the Service.

14. Suspension and termination

We may suspend or restrict your access to the Service immediately if we reasonably believe that:

  • You are in material breach of these terms.
  • Your use of the Service poses a security risk or may cause harm to other users.
  • Your account is being used fraudulently or for unlawful purposes.
  • We are required to do so by law or regulation.

We may terminate your account and these terms at any time by giving you 30 days' written notice by email.

You may terminate your account at any time by cancelling your Subscription as described in Section 5.

On termination, your right to use the Service ceases immediately (or at the end of your current Billing Cycle in the case of a voluntary cancellation). Any outstanding fees remain payable. We will delete your account data in accordance with our Privacy Policy.

15. Changes to the Service

We may update, modify or discontinue any part of the Service at any time. We will endeavour to give reasonable notice of material changes. If we discontinue the Service entirely, we will provide at least 30 days' notice and, where appropriate, offer a pro-rata refund for any prepaid period.

16. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by email or through a notice within the Service at least 14 days before the changes take effect.

Your continued use of the Service after the updated terms take effect constitutes your acceptance of the changes. If you do not agree to the updated terms, you must stop using the Service and cancel your Subscription.

17. Electronic communications

By creating a Sift account, you consent to receive communications from us electronically, including by email and through notifications within the Service. You agree that all notices, agreements, disclosures and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

It is your responsibility to ensure that the email address associated with your account is current and that you check it regularly. We are not liable for any failure to receive a notice caused by an outdated or incorrect email address.

18. Governing law and disputes

These terms are governed by and construed in accordance with the laws of England and Wales.

Any dispute arising out of or in connection with these terms (including any non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Nothing in this section limits your right to bring enforcement proceedings in another jurisdiction, or to seek injunctive or other equitable relief in any court of competent jurisdiction.

19. General provisions

  • Entire agreement: These terms, together with our Privacy Policy at siftrecruit.com/privacy, constitute the entire agreement between you and us in relation to your use of the Service.
  • Severability: If any provision of these terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
  • Waiver: A failure or delay by us in exercising any right under these terms does not constitute a waiver of that right.
  • Assignment: You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign our rights and obligations without restriction.
  • Force majeure: We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control.
  • No third-party rights: These terms do not confer any rights on any person other than you and us. No third party may enforce any term of this agreement under the Contracts (Rights of Third Parties) Act 1999.
